ACCEPTING OUR TERMS AND CONDITIONS

By using this website (www.goodwintractorparts.co.ukwww.goodwinfarm.com) or by placing an order with us, you are agreeing to the following Terms and Conditions. Any orders placed placed by you must be placed strictly in accordance with these Terms and Conditions.

The term 'Goodwin Farm Services Ltd' or 'our' or 'we' or 'us' refers to the owner of this website which is Goodwin Farm Services Ltd, Woodside Cottage, Blythe Bridge Bank, Kingstone, Staffordshire ST14 8QW. The term 'you' refers to the viewer or user of the website.

An order will only be accepted when we receive full payment for the goods ordered.

PRICES

The price you pay for the goods you order are set out in our website or as confirmed over the telephone at the time you make the order.

The delivery charges are set out on our website or as confirmed over the telephone. We can quote delivery charges within the UK and Irish Republic via our website although it may not always be possible to deliver to some locations. You may be required to pay extra for very bulky items or to some locations. Please contact us if you live in the Channel Islands.

Worldwide Delivery.

For most European and other worldwide destinations please contact us by email or telephone and we will be happy to give you a quote.  If you are unable to obtain a quote from our website please email or call us and we will get back to you with a delivery cost. 

PARTS AND GOODS SUPPLIED

Any OEM references, part numbers, names, images or descriptions are not intended to indicate or suggest that our parts are made by that OEM.

Goods must be checked by the purchaser on receipt to ensure they are suitable for their intended purpose. Parts must be fitted by competent persons.

We shall not be liable for any injury, loss or any damage relating to the parts or machinery we supply.

The weights displayed on the website are estimates only for the purposes of packaging and may not reflect the actual weight of the product. 

New Parts

We supply new parts unless otherwise stated. We do not supply parts manufactured by the OEM (Original Equipment Manufacturer) and any reference to tractor makes or original part numbers (OEM) are for reference purposes only . We make every effort to ensure that our product descriptions, price and product images are as up to date as possible. However, this information may not reflect the position when an order is placed. Products may differ from the image or description depending on our supplier or manufacturer. We reserve the right to alter/edit this website at any time or withdraw any product, materials or content from this website.

Reconditioned or Exchange Parts.

Some of our parts such as clutches, may be reconditioned and may require a serviceable old unit in exchange. It is the customers responsibility to send us their serviceable old unit at their own cost. We advise that the customer uses a courier with signed for delivery. A surcharge will be levied until an old unit is received. The surcharge will be clearly stated in the description of the goods. We reserve the right to surcharge if the old unit sent to us by you is not in our opinion serviceable, or doesn't meet the criteria for the exchange. However, we will normally contact a customer by email or telephone to confirm the order and we will always try to assist or advise depending on their location or circumstances. If in doubt, please call us to discuss your requirements.

Used Parts

Any used parts advertised on this site are not available to buy online. If you are interested in purchasing a part you see advertised we ask that you contact us on 01889 500303. Used parts or machinery are untested and should be checked by the purchaser to ensure they are suitable for the proposed application and comply with the Health and Safety at work regulations.

All parts are to fitted by competent persons only. We shall not be liable for any injury, loss or any damage relating to the parts or machinery we supply.

Warranty & Guarantees

No warranty or guarantee is given on any parts supplied unless specifically stated in the descriptions given on this website. Some of the new parts supplied by us are covered by our manufacturers and suppliers standard warranties. Any warranty is subject to that manufacturer or suppliers specific Terms and Conditions. Any warranty that may be available will be voided if the item supplied it is subjected to unreasonable usage, abuse or if the product is not used for its intended purpose. Please contact our Customer Services on 01889 500303 if you have any queries prior to purchase or contact us in the first instance if you think you may have a warranty claim.

ORDERS

If you make an order through our website or by telephone we will confirm that your order has been accepted by sending an email at the address you provide on your order form or by telephone.

The title of the goods shall not pass to you, the customer, until full payment has been received.

Your order will not be processed until full payment has been received. We accept payments through our secure website most credit or debit cards by our payment processor Sagepay and by Paypal. Alternatively we accept orders by debit/credit card by telephoning 01889 500303, We also accept cheques (payable to Goodwin Farm Services Ltd), bank transfer and postal orders. Please call us if you wish to order in this way.

Once you have agreed to order from us, you also agree to purchase the goods and allow Goodwin Farm Services to use the personal details given to us by you for the order. These will only be used for the purposes of completing your order (s). This will include passing your details onto carriers/couriers and payment processors. All personal details are held in accordance with our Privacy Policy and can be removed from our system by written request. Our Privacy Policy is available to view on this website.

Cancellation by us

We reserve the right to cancel the contract between us if:

  • We have insufficient Stock to deliver the goods/parts you have ordered.
  • We do not deliver to your area.
  • We are unable to obtain authorisation for your payment.
  • We identify a pricing or product description error.

If we have to cancel your order, we will re-credit your debit/credit card to your account as soon as possible but in any event within 30 days of your order. We do accept any responsibility or liability for any loss or disappointment if we are unable to supply.

Cancellation by you

You are covered, as a consumer in the UK, by Consumer Protection, Distance Selling Regulations, Consumer Contracts Regulations unless you are a business.

You may properly examine the goods for 7 days, however you may not return any goods which have been installed or fitted unless they are faulty.

You have the right to cancel your contract at any time up to 7days after delivery. To cancel please email or write to us.

You do not have to give a reason for cancellation, but a brief explanation will help us improve the service we offer customers in the future.

If you cancel, you must return the goods within 14 days of cancellation, complete with the original packaging to us or our supplier (or any other UK address specified by us), at your own expense.

If you cancel the contract but we have already processed the goods for delivery, you must not unpack the goods when they are received and you must send the goods back to us within 7 days at the address we supply to you when you have notified us of cancellation. Refusal or inability by you to accept goods for delivery will not constitute a cancellation and if you do so, we reserve the right to levy a surcharge for any additional costs incurred for their return.

When you return goods, you must ensure that these goods are adequately packaged to protect against damage. We advise that the goods are returned using a tracked or signed for service.

Once you have notified us that you are cancelling your contract, any sum debited from your credit card will be refunded/re-credited to your account as soon as possible and in any event within 30 days PROVIDED THAT the goods are returned by you at your expense to us in the condition they were delivered to you. Goods must be returned in a clean, re-saleable condition and in their original packaging when applicable. The cost of returning the goods will be covered by the you.

If you do not return the goods delivered to you or do not pay the costs of delivery, we will be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Special Orders

The Distance Selling Regulations are not applicable for special order items. These would be parts that are not normally advertised on our website. These parts would not normally be eligible for refund, unless faulty or defective.

DELIVERY

We will normally notify you by email when your goods are despatched. We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. Orders are usually despatched within 1-2 working days and in any event within 30 days of your order. Some orders will require a signature on delivery. If there is nobody available at the address you give to us to sign for the goods, it is your responsibility to contact the delivery company if they request a re-delivery and to ensure that the delivery can be made to you.

Refusal or inability by you to accept goods for delivery will not constitute a cancellation and if you do so, we reserve the right to levy a surcharge for any additional costs incurred for their return.

You will be become the owner of the goods when they are delivered to you. Once the goods have been delivered to you they will be held at your own risk and we will not be liable for them.

If you do not receive the goods within 5 working days of us notifying you that they have been despatched, please contact us. It is only possible to arrange replacement goods when the courier company confirm that your parcel has been lost or damaged. In the case of delivery companies such as the Royal Mail, claims can only be made after 30 days.

In any event, if you do not receive the goods within 30 days of the date which you ordered them, we have no liability to you unless you notify us us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.

Missing Goods

On receipt of the goods you agree to examine the contents of the parcels delivered. We shall have no liability to you unless you examine the goods and notify us by email as soon as possible if any item(s) you ordered are missing and in any event within 2 working days after delivery. Our liability is limited to:

 - Sending a replacement item to you. In this instance, we will not charge additional postage costs to send a replacement item.

 OR

- If it is not possible to send a replacement item, a full refund of the price you paid for that item.

Defective, Damaged or Incorrectly Supplied Goods

We shall have no liability to you for defective goods or if items you have ordered from us are not what you ordered UNLESS you will examine the goods when they are delivered and notify us as soon as possible or in any event within 10 working days by email if there are any items that are defective or damaged or if any item is not what you ordered (incorrectly supplied).

You must return to us any defective, damaged or incorrectly supplied goods for refund. In the case of defective or faulty goods, we will refund you the postage cost of returning the goods to us. Our liability to you is limited to:

- A refund of your postage costs for returning the item(s).

- A refund of the amount paid by you for the goods in question in whatever way we choose OR to replace or repair the goods in question.

We will not charge further postage charges if we replace the goods in question.

Events Beyond Our Control

We will have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

LEGAL RIGHTS

None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without effecting the validity of the remainder.
